Terms of Service

These Terms of Service (the "Terms") govern your access to and use of Rupta (the "Service"), operated by Federico Bello ("Rupta", "we", "us"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 13 years old to use Rupta. If you are between 13 and the age of majority in your country, you confirm that your parent or legal guardian has reviewed and accepted these Terms on your behalf. We may restrict access in jurisdictions where the law requires a higher minimum age.

2. Your account

You create your Rupta account by signing in with Apple or Google. You are responsible for keeping your credentials confidential and for all activity that occurs under your account. Let us know as soon as you believe your account has been accessed without your authorization.

You agree to provide truthful information when creating your profile and to keep it reasonably up to date. You may not impersonate another person or create accounts on behalf of others without permission.

3. Acceptable use

By using Rupta you agree not to:

• Upload fake, staged, or fraudulent proof of quests, or misrepresent activity to earn AURA.
• Harass, threaten, intimidate, or stalk other people; post hateful, sexual, or violent content directed at other people.
• Post content depicting illegal activity, self-harm, dangerous stunts, or that could put minors at risk.
• Upload content you don't have the right to share, or that infringes another person's intellectual property or privacy.
• Attempt to interfere with the Service, probe for vulnerabilities, or use automated tools to scrape or overload our systems.
• Use the Service for unlawful purposes or in violation of applicable law.

We may remove content, suspend accounts, or terminate access at our discretion when we believe these Terms or applicable law have been violated.

4. Your content

You retain ownership of the photos, videos, descriptions, comments, and other materials you submit to Rupta ("Your Content"). You grant Rupta a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt (for technical purposes such as resizing or transcoding), display, and distribute Your Content solely to operate, improve, and promote the Service. This license ends when you delete Your Content or your account, except for backup copies retained for a limited period and copies other users have already received under their own privacy settings.

You represent that you have the right to share Your Content and that doing so does not violate third-party rights.

5. Quests, completions, and AURA

AURA is an in-app point system used to record quest completions and rank participation. AURA has no monetary value, cannot be redeemed for cash or credit, and may be adjusted, removed, or recalculated by Rupta at any time, including (without limitation) where we detect completions submitted in violation of these Terms.

Rupta may review submitted proof and reclassify, remove, or hide completions that appear to violate the acceptable use rules.

6. Assumption of risk and indemnification

Rupta is a content and gamification platform. We do not organize, supervise, direct, certify, or guarantee the safety of any quest: quests are activity suggestions that each user chooses, plans, and carries out on their own and at their own discretion.

Many quests involve physical activity, travel, interaction with third parties, use of public or private spaces, or environments we do not control. By participating in a quest, you knowingly and voluntarily acknowledge and accept all risks inherent to those activities, including, without limitation, personal injury, disability, property damage, or death, and you assume those risks entirely on your own. It is your responsibility to assess your physical condition, use appropriate safety equipment, comply with applicable law and the rules of the location where you perform the activity, and abandon any quest you cannot complete safely.

To the maximum extent permitted by law, you agree to indemnify and hold harmless Rupta, Federico Bello, and their directors, employees, and agents from any claim, damage, loss, or expense (including reasonable legal fees) arising out of or related to your participation in a quest or your breach of these Terms, except to the extent such claim arises from Rupta's willful misconduct or gross negligence.

7. Rupta Pro subscription

Rupta Pro is an optional auto-renewing subscription that unlocks additional features. You can purchase it through Apple's App Store or Google Play. The current price is shown in the app at the time of purchase.

Subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before the renewal date. Renewals are billed by Apple or Google to the payment method on file with those platforms.

You can manage and cancel your subscription from your Apple ID or Google Play subscription settings. Refunds, where applicable, are handled by Apple or Google under their own policies. Deleting your Rupta account does not automatically cancel an active subscription — cancel it separately through Apple or Google.

If we change Pro's features, pricing, or plans, we'll give you reasonable notice in-app or by email. Material changes won't take effect for a subscription period you've already paid for.

8. Intellectual property

The Rupta name, logo, app, and underlying software are owned by Rupta and protected by copyright, trademark, and other laws. We grant you a personal, limited, non-transferable, revocable license to use the Service for its intended purpose. These Terms grant no other rights.

9. Termination

You can stop using Rupta at any time, including by deleting your account from the app or following the steps on the Account deletion page.

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or if your continued use poses a risk to other people or to the Service.

10. Disclaimers

Rupta is provided "as is" and "as available." To the maximum extent permitted by law, Rupta disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee the Service will be uninterrupted, error-free, secure, or free of harmful components.

Rupta promotes real-world activities. You are solely responsible for assessing whether a quest is appropriate and safe for you. Don't attempt activities beyond your physical ability or that violate local laws.

11. Limitation of liability

To the maximum extent permitted by applicable law, Rupta and its directors, employees, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for personal injury, disability, or death, or for loss of profits, revenue, data, or goodwill, arising out of or related to the Service or to your participation in a quest, even if Rupta has been advised of the possibility of such damages. Our total cumulative liability related to these Terms is limited to the greater of (a) the amount you paid Rupta in the twelve months before the event giving rise to the claim, or (b) USD 50. This limitation does not apply to the extent mandatory law prohibits excluding or limiting liability for willful misconduct or gross negligence.

12. Changes to these Terms

We may update these Terms from time to time. When we do, we'll update the "Last updated" date above and, for material changes, notify you in-app or by email. Continued use of the Service after the new Terms take effect constitutes your acceptance.

13. Governing law

These Terms are governed by the laws of Uruguay, without regard to its conflict-of-laws principles. Any dispute will be submitted exclusively to the competent courts of Uruguay, unless mandatory consumer-protection law in your country of residence provides otherwise.
